Regulamin

These terms apply to all appointments, quotes and agreements between Cords Cycles, Oudedijk 163b, 3061 AB Rotterdam, registered with the Dutch Chamber of Commerce under number 70966664, and its customers. If you are a consumer, your statutory rights always take precedence.

1. Definitions

  1. 1.Cords Cycles: the bicycle atelier at Oudedijk 163b, Rotterdam, reachable at cordscycles@gmail.com and +31 6 34 02 38 65.
  2. 2.Customer: any person or business entering into an agreement with Cords Cycles.
  3. 3.Consumer: a customer not acting in the course of a trade or business.
  4. 4.Work: servicing, repair, adjustment, assembly and custom builds.

2. Scope

  1. 1.These terms apply to every quote, configuration, appointment and agreement.
  2. 2.Deviations only apply when confirmed in writing or by email.
  3. 3.If a provision is void, the remaining provisions continue to apply.

3. Quotes, configurations and prices

  1. 1.A configuration from the build tool or a PDF is a non-binding price estimate, not a binding offer.
  2. 2.An agreement only exists once Cords Cycles confirms the order in writing or by email.
  3. 3.Consumer prices are in euros including VAT.
  4. 4.Obvious mistakes or typing errors in prices do not bind Cords Cycles.

4. Servicing and repairs

  1. 1.Service appointments are booked through the online planner.
  2. 2.Fixed service prices cover labour; parts are charged separately.
  3. 3.If extra parts or hours would raise the agreed price by more than 10%, we ask your approval first.
  4. 4.Replaced parts can be returned to you on request; otherwise we dispose of them responsibly.

5. Orders, deposit and delivery

  1. 1.A deposit may be requested for custom builds and special-order parts.
  2. 2.Delivery times are indicative and depend on suppliers; we keep you informed of delays.
  3. 3.If a delivery time is exceeded considerably, a consumer may cancel and receive a refund of amounts paid.
  4. 4.A build is assembled within one week of receiving all parts, unless agreed otherwise.

6. Payment

  1. 1.Payment is due at collection or as stated on the invoice, by debit card, Visa, Mastercard or bank transfer.
  2. 2.Instalments or leasing run through the provider under its own terms; Cords Cycles does not provide credit.
  3. 3.Consumers first receive a free reminder with 14 days to pay before statutory interest and collection costs under article 6:96 of the Dutch Civil Code apply.
  4. 4.Cords Cycles may retain a bicycle until the work has been paid for (right of retention).

7. Collection

  1. 1.We let you know when your bike is ready.
  2. 2.If a bike is not collected after three months and two written reminders, reasonable storage costs may be charged and, after further notice, the bike may be sold to recover outstanding costs, in line with article 6:90 of the Dutch Civil Code.

8. Right of withdrawal

  1. 1.For distance purchases, consumers have a 14-day cooling-off period after receipt.
  2. 2.This does not apply to products made to your specifications, such as a custom build.
  3. 3.It lapses for services fully performed with your explicit consent.
  4. 4.Purchases and appointments made in the atelier are not covered by the statutory right of withdrawal.

9. Conformity and warranty

  1. 1.You are entitled to a product that meets the agreement and the properties you may expect in normal use (article 7:17 of the Dutch Civil Code).
  2. 2.Manufacturer warranties from brands such as Basso and Omnium apply in addition to, never instead of, your statutory rights.
  3. 3.We give a 3-month workmanship warranty on work performed.
  4. 4.Normal wear, crash damage, misuse, poor maintenance or third-party repairs are excluded.

10. Liability

  1. 1.Cords Cycles is liable for direct damage caused by an attributable failure, up to the invoice amount of the relevant order.
  2. 2.This limit does not apply to intent, deliberate recklessness, death or personal injury.
  3. 3.Please remove personal items from your bike before leaving it.

11. Complaints

  1. 1.Report complaints as soon as possible, preferably within two months of discovery, via cordscycles@gmail.com.
  2. 2.We respond substantively within 14 days.
  3. 3.If we cannot resolve it together, consumers may use the EU ODR platform: ec.europa.eu/consumers/odr.

12. Privacy

  1. 1.We only use your data to perform your order, stay in touch and meet legal obligations, in line with the GDPR.
  2. 2.You can request access, correction or deletion at any time via cordscycles@gmail.com.

13. Governing law

  1. 1.All agreements are governed by Dutch law.
  2. 2.Disputes are submitted to the competent court in the Rotterdam district, unless the law gives the consumer another choice.
  3. 3.Consumers living outside the Netherlands keep the protection of the mandatory rules of their own country.
